3. User Responsibilities

You must ensure that your vehicles are accessible for scheduled maintenance and that all necessary safety protocols are followed. Any damage to our facilities or equipment due to negligence may result in additional charges.

4. Service Agreements and Scheduling

Service appointments are subject to availability and must be scheduled in advance. We reserve the right to refuse service to any vehicle that poses safety risks to our technicians or facilities. Emergency services are available 24/7 but may incur additional charges.

Cancellations must be made at least 24 hours in advance to avoid cancellation fees. Repeated no-shows may result in termination of service agreements. Service estimates are valid for 30 days unless otherwise specified.

5. Payment Terms

Payment is due within 30 days of service completion unless otherwise agreed upon in writing. We accept various payment methods including credit cards, bank transfers, and corporate accounts. Late payments may incur interest charges as permitted by Canadian law.

All prices are subject to applicable taxes and fees. For fleet service agreements, payment terms may be negotiated based on service volume and contract duration. Disputed charges must be reported within 60 days of billing.

6. Warranties and Liability

We warrant our workmanship for a period of 90 days from service completion. Parts warranties are subject to manufacturer terms and conditions. Our liability is limited to the cost of correcting defective work or replacing defective parts.

ProFleet Auto shall not be liable for any indirect, incidental, special, or consequential damages arising from our services. Our total liability shall not exceed the amount paid for the specific service in question.

7. Privacy and Data Protection

We are committed to protecting your privacy and personal information in accordance with Canadian privacy laws. Our Privacy Policy, which is incorporated by reference into these Terms, describes how we collect, use, and protect your information.

Vehicle diagnostic data and maintenance records are kept confidential and are only shared with authorized personnel or as required by law. You have the right to access and request corrections to your personal information.

9. Termination of Service

Either party may terminate service agreements with 30 days written notice. We reserve the right to immediately terminate services for non-payment, breach of terms, or conduct that endangers our staff or facilities.

Upon termination, you remain responsible for all outstanding charges and must arrange for removal of your vehicles from our premises within 48 hours. Failure to do so may result in storage charges.

10. Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of Canada and the province in which services are performed. Any disputes shall be resolved through binding arbitration in accordance with the rules of the Canadian Arbitration Association.

If any provision of these terms is found to be unenforceable, the remaining provisions shall continue in full force and effect. These terms constitute the entire agreement between the parties regarding the subject matter herein.
